I was involved in a rear end accident with a tractor trailer. What should I do to protect myself legally?

Any rear-end automobile accident can do serious damage to both vehicles and cause significant injuries to the passengers in those vehicles. However, when the vehicle involved in the accident is an extremely large truck that weighs many tons, the injuries and property damage are likely to be catastrophic.

If you have been injured in a rear-end collision involving a tractor trailer, you are not alone. The Federal Motor Carrier Safety Institute did a study that found that there are over 400,000 accidents every year involving large trucks, and almost 20 percent are rear-end collisions. These accidents are particularly dangerous because large trucks have a much larger stopping distance, and large trucks are 40 or more times heavier than other vehicles they share the roads with. Also, in about 20 percent of the accidents that were studied, three or more vehicles were involved when the truck rear-ended another vehicle. The study found that over 23,000 people are injured every year and 700 are killed each year in rear-end truck accidents.

In most rear-end collisions, the vehicle driving in the rear is blamed. When the vehicle is a tractor trailer, the company who employs the driver is typically financially responsible for the accident. However, most commercial trucking companies that own tractor trailers hire teams of attorneys in an effort to pay out as little as possible.

Commercial trucking accident cases can be complex. There are typically several companies that could be held liable in a trucking injury case. Because of the complexities involved, it’s important that accident victims have an attorney who can represent them and protect their interests.
