Texas Worker Dies in Industrial Accident in Tarrant County

A 37 year old man was killed in an industrial accident two weeks ago at Foliage Factory Landscape on White Settlement Road in Tarrant County. According to the sheriff’s office, the man was operating a piece of equipment when an elevated crossbar came down on him while he was working on the engine. The machine was not turned on at the time of the accident.

First responders attempted CPR on the injured man, but he died at the scene. He had only been with the company for four months. It’s unclear what caused the crossbar to come down on him while he was working.

The loved ones of a person killed in an industrial or another workplace accident have several legal options. They may be entitled to workers’ compensation death benefits. Workers’ comp death benefits are normally available to people who were related to the deceased worker and were financially dependent on that person. In Texas, death benefits can be paid to a surviving spouse, minor children, children in school who are under 25, dependent grandchildren, or other dependent family members. Death benefits normally equal 75 percent of the deceased employee’s average weekly wage. Burial benefits may also be available.

The loved ones may also be able to file a lawsuit against a negligent party who contributed to the accident. For example, if a piece of equipment was defectively manufactured or designed, and this led to an industrial accident in which a worker was killed, the worker’s family can sue the manufacturer for damages.
